Joe Satriani isn't nominated for a Grammy, but his lawyer still hopes he wins

Until now, it looked as though major drama could unfold at this Sunday's Grammy Awards, with Joe Satriani's legal team threatening to serve Coldplay with papers in the lawsuit he has brought against them pertaining to their song Viva La Vida, which he claims infringes on the melody to his song If I Could Fly, reports Music Radar.

"All of that has been averted now," says Howard King, Satriani's attorney, speaking exclusively to MusicRadar. "Coldplay have hired one of the finest entertainment firms in California, which is probably good for all. Their new firm will have a keen understanding of the strengths and weaknesses of the claims," says King, "and will counsel the band to come to a quick and fair resolution of the situation."

Satriani's attorney hopes for fair resolution

It could have gone another way, however, says King. Until very recently, Coldplay did their best to brush off Joe Satriani's claims of plagiarism.

"We tried to have a conversation with Coldplay before we even filed the suit," says King. "Their British lawyers said there wasn't anything to discuss. And then after we filed the lawsuit, they didn't agree to accept service of the complaint."

As King explains it, "You have to hand someone legal papers in order for matters to proceed - much like in a divorce, you have to be served."

Coldplay could have been served at Grammys

As of two weeks ago, Coldplay's UK law firm still hadn't accepted the service of complaint, and that's when King said, "Enough. If that's the way they want it, we'll serve the band in California when they're here for the Grammys."

According to King, arrangements were made to serve Coldplay at parties and various locations in California. "We knew where they were going to be at," he says. "And if all else failed, if they didn't accept the papers, we would have had no choice than to take care of matters at the Grammys."

While King doesn't come right out and say that this week's publicity surrounding the lawsuit forced Coldplay to hire a US attorney, he does admit that it's "somewhat coincidental. Who would want to be hit with legal papers on the red carpet?"

And what does King think of Coldplay's chances of winning on Grammy night? "We hope Joe Satriani's song wins a Grammy," he says with a laugh. "In fact, we hope Joe has a very big Grammy night!"

More on this exclusive news article here [thanks mimixxx]

'Quite Big News' to be Announced on Coldplay.com - Friday 6th Feb, 12pm (GMT)

Things have been relatively quiet on the Joe Satriani vs. Coldplay front since the guitarist filed a copyright-infringement lawsuit against the band in December, claiming that Coldplay's "Viva La Vida" was too similar to the melody of his instrumental "I Just Wanna Fly"... until this week.

Reports surfaced on Wednesday that Satriani was so fed up with the band allegedly dodging his attempts to serve them with papers in the suit that, according to Fox News, he planned an ambush at this Sunday's Grammy awards, where the group is up for seven awards. Among the nominations are Record of the Year and Song of the Year for "Viva la Vida," which is also up for Best Pop Performance by a Duo or Group with Vocals. Fox reported that Satriani and lawyer Howard King were planning to "fill the Grammys with servers ready to pounce on [Coldplay singer] Chris Martin and his fellow bandmates." There were also plans to send a fleet of photographers to document the event.

But King told MTV News on Thursday (February 5) that there won't be any such drama after all.

"The members of Coldplay have retained a lawyer, who has agreed to accept service of the complaint on their behalf," King wrote in an e-mail. "Therefore, there will be no attempt to personally serve the band while they are in Los Angeles." But had they not retained that lawyer, King said he would have cornered the band, "either at the Grammys or any of the other events we knew they are planning to attend."

Satriani is seeking a jury trial in the dispute, as well as damages and "any and all profits" attributable to the alleged copyright infringement. Coldplay responded to the suit within a week of its filing, writing on their Web site, "With the greatest possible respect to Joe Satriani, we have now unfortunately found it necessary to respond publicly to his allegations. If there are any similarities between our two pieces of music, they are entirely coincidental, and just as surprising to us as to him. Joe Satriani is a great musician, but he did not write the song 'Viva la Vida.' We respectfully ask him to accept our assurances of this and wish him well with all future endeavours."

A spokesperson for Coldplay could not be reached for comment at press time.

-------

What do you think about the whole situation?
As we reported yesterday, HuffingtonPost.com and Fox News are both reporting that Coldplay might get served with legal papers in a law suite by Joe Satriani at this weekend's Grammy Awards. Today it is being reported that Coldplay's legal team were informed of those plans ahead of the awards ceremony this weekend.

Last year Satriani claimed that Coldplay's Grammy nominated hit "Viva La Vida" ripped off his song "If I Could Fly" (see the video after the break). Howard King, Satriani's Lawyer, has hired an army of process servers to make sure that the band gets served at the Grammys, he has made sure to hire enough camera men to get the whole thing on video, and he even had the decency to inform Coldplay's legal council of the plans.

Now this potential public humiliation might seem a bit like over kill but King had previously reported that they had tried to solve the matter privately. "We attempted to have a dialogue on this before we went public," King said. "We felt almost forced to file suit. As far as the 'coincidence,' ultimately that's for a jury to decide," he added.

Satriani, 52, wants a federal judge to order an accounting so he can determine how much money he may be owed, or else stop using the song. In response to Coldplay's statement, Satriani's lawyer, Howard E. King, said Coldplay's public reaction was dramatically different from how the guitarist's claims were treated before the lawsuit was filed.

King said it's common for musicians to be influenced by other works and incorporate it into their own, sometimes a little too closely. But he said that the reaction is usually different when the similarities are pointed out. "It doesn't mean you don't owe something to the original composer," he said.

Coldplay is one of the world's top-selling pop acts, and their latest CD, "Viva La Vida," has sold nearly 2 million copies in the United States alone. It was nominated last week for seven Grammys, including album of the year and record of the year for the title track.

Coldplay had recently fired back against the accusations regarding Viva La Vida. In a statement released on Coldplay.com, the band responded to a copyright infringement lawsuit filed by guitarist Joe Satriani last week in federal court in Los Angeles. That lawsuit says the Grammy-nominated song contains "substantial, original portions" of his 2004 song, "If I Could Fly."

"With the greatest possible respect to Joe Satriani, we have now unfortunately found it necessary to respond publicly to his allegations," read the statement. "If there are any similarities between our two pieces of music, they are entirely coincidental, and just as surprising to us as to him. Joe Satriani is a great musician, but he did not write the song 'Viva La Vida.' We respectfully ask him to accept our assurances of this and wish him well with all future endeavours."

The Oracle Speaks on Coldplay's Hectic February Schedule

Hi, Oracle. I can't get what does happen at this time? Are you sure that you are playing in Japan from Feb 11 to Feb 15? How are you gonna held between a charity concert and the concerts in Japan?

The Oracle replies:

Yes we're sure and then heading for London to play the Charity show on the 18th February.

February 4, 2009 - submitted by Bonnie, United States of America

Q. Hey there Oracle! I've heard a live Coldplay song that starts "Honey, its been a long time coming, and I can't stop now..."? Can you please tell me what this track is and where can I find it? It sounds beautiful! Thanks!

The Oracle replies:

This is Gravity, which was first played live during the Rush of Blood tour. It was officially released by Embrace as a single in 2004. Coldplay later recorded it in 2005 and it appeared on the Talk single and that's where you can find it.

February 4, 2009 - submitted by Ariane, Australia

Q. Hey Oracle! I know you don't answer questions on weekends but do the questions that are sent in on weekends get read or put aside? I realised recently that I've probably sent in several questions on our Monday while it's still been Sunday in the UK. PS Kudos to Chris for sewing the Pakistani flag onto his Viva jacket, I noticed it watching the XFM set.

The Oracle replies:

There's huge vault of questions now, some waiting to be read, some waiting to be answered and to tell you the honest truth.. some waiting to be deleted! The reason is that a lawyer representing musician Joe Satriani is sending teams of process servers all over town to hand them a plagiarism lawsuit. Satriani filed a copyright infringement suit in Los Angeles on December 4, one day after Coldplay was nominated for seven Grammy Awards, including record of the year for "Viva La Vida". He is seeking a jury trial, damages and "any and all profits" attributable to the alleged copyright infringement.

Satriani's attorney Howard King of King Paterno et al. says, "We have warned their British lawyers that we have hired a fleet of process servers lined up to dog the band everywhere they go this weekend in the hopes of serving them."
