Channel [V] & musicMAX have got tickets to the year's most exclusive gig to give away. Coldplay are returning to Oz and we've got them for a 'fan only' gig at the Sydney Opera House on Thur 17 July. "Coldplay's Biggest Fan" Competition

Terms and Conditions

Entry into the musicMAX & Channel [V] “Coldplay’s Biggest Fan” Competition (the “Competition”) is open to all residents of Australia. The Promoter is XYZ Entertainment Pty Limited (ACN: 066 812 119) of Wharf 8, Pyrmont, New South Wales, 2009.

The officers, management and employees (or immediate family of an officer, manager or employee) of XYZ Entertainment, Foxtel, Austar, Optus Television or any sub-licensees are not eligible to enter.

Competition begins at 09.00am (EST) on 21 June 2003 and entries close at 11.59pm (EST) on 13 July 2003 (the “Competition Period”).

There are twenty five (25) major prizes. Each major prize consists of a double pass to see Coldplay’s live, intimate, private performance (200 capacity) at the Opera House, Sydney, NSW on 17 July 2003. The prize does not include transport to Sydney and excludes all ancillary costs/expenses which are not specified in the terms and conditions. The major prize is valued at $0.1c each.

All Prize values are the recommended value as provided by the supplier. Total prize pool is valued at $0.25c

All eligible entries will be judged by Legion Interactive and the Promoter commencing at 9am on 14 July 2003 on the basis of creativity and originality. Chance plays no part in determining the Winners of the Major Prizes. Winners will be notified by phone and names posted on the musicMAX & Channel [V] websites from 15 July 2003.

Entries can be made by calling 1900-957-244 and following the instructions. Entries must include:

a) in 25 words or less tell us why you are Coldplay’s biggest fan

b) the entrant’s full name, residential address & day time phone number including area code

c) entrants must be able to make their own way to Sydney for the event

No responsibility will be taken by the Promoter, Foxtel, Austar, Optus or any sub-licensees for lost or late entries due to technical or any other reason.

No responsibility will be taken by the Promoter, Foxtel, Austar, Optus or any sub-licensees for any changes in dates or times or cancellations or rescheduling of events or other arrangements that may prevent the Major Prize winner from participating in the Major Prize.

The conduct of the Major Prize winners may be broadcast by the Promoter on its Channel [V] &/or musicMAX, live on-air, or in a recorded format, on or about the date of the Major Prize. musicMAX may, in its absolute discretion, repeat broadcasts of the Major Prize at any time, and from time-to-time.

In the event that the Promoter postpones or varies the Major Prize it shall not be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, the postponement or variation of the Major Prize.

A decision of the Promoter’s in relation to the conduct of the Competition is binding and conclusive and will not be challenged on any grounds, including without limitation, the grounds that the Promoter’s failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles of procedural fairness. The Promoter’s decision will remain binding and conclusive notwithstanding that it can be demonstrated that the Promoter made a decision which was wrong, based on a factual error or an irrelevant or irrational consideration. It is not the Promoter’s policy to enter into negotiations with viewers, Major Prize winners or the Major Prize winner who challenge a decision made by the Promoter.

The Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Major Prize. Subject to the foregoing, if the Promoter is liable for any claim by a Major Prize winners including a claim arising from the Promoter’s negligence, the Promoter’s liability for any such claim shall not exceed $1, 000.

All entries become the property of the Promoter and may be used for promotional purposes.

It is the entrant’s responsibility to inform the Promoter if their residential address, email or phone number changes during the Competition Period.
