Cole claims articles about his private life are an invasion of his privacy Chelsea footballer Ashley Cole is to sue two newspaper groups saying articles claiming he cheated on his wife, Girls Aloud's Cheryl Cole, breached his human rights. Using a similar defence to the one employed by Max Mosley earlier this year, Cole is launching a privacy battle against Mirror Group Newspapers and News Group Newspapers claiming that the stories were an 'unjustified intrusion' into his personal life. Mirror Group publish the Daily Mirror and two Sunday papers while News Group publish The Sun and the News of the World. The articles appeared in the newspapers in January and February and alleged the star had an affair with three women. Cole says he was embarrassed and distressed by the stories, which also upset his wife. His counsel, David Sherborne, told the court that the stories contained 'private information which represents an unjustified intrusion' into Cole's private life. His privacy action will not distinguish between fact or fiction, but Cole claims some of the information in the articles was made up. Last July Max Mosley, the Formula 1 supremo, won £60,000 damages after a landmark privacy action against the News of the World regarding a spanking and bondage orgy with five prostitutes. His victory came after the High Court dismissed the paper's claims that there were Nazi overtones to the sex sessions and so they had a duty to report the story in the public interest. Legal experts warned at the time that the judgment could have major implications for Press freedom. The newspapers who are contesting Ashley Cole's action, said that both Cole and his wife, Cheryl, had put a 'mass' of information about their personal life into the public domain already and promoted themselves for publicity. Ashley Cole and Cheryl are photographed as they celebrate Cheryl's 25th birthday this year Their lawyer argued that, since publication of the articles, the Coles had also continued to speak publicly about their marriage and Ashley's alleged affairs. Neither Cole nor his wife attended the preliminary case management conference. The estimated four-week trial will be heard by a judge in London, sitting without a jury, next autumn.
