Once it was pointed out? Trust me. They knew from the get go that they were lifting the melody from Computer Love. They have talked about it. When Talk finally turned into a song they thought might get released, they wrote to Kraftwerk to get permission to use it. Kraftwerk is credited on the X and Y album sleeve for Talk. They did not release Talk and then get permission from Kraftwerk to dodge a lawsuit. Did not happen. :)

Considering that on X and Y they did actually lift a rift from Kraftwerk AND asked permission to use it, I highly doubt they would have intentionally lifted a rift or melody for Viva. If they had heard this song and liked it and wanted to use it, they would have asked permission and given him credit. End of story.

If this guy thought his song had been copied - legitimately copied - then he would have filed this lawsuit the second the song hit the airwaves. The song isn't the issue here. He is after the money. Ale is right. If Viva had bombed, this wouldn't be happening.
