This is part of what I'm writing right now:

 

The Supreme Court first discussed the issue of right to counsel in the Powell v. Alabama case of 1932, in which seven defendants were accused and convicted of rape. The Court ruled that “’in a capital case, where the defendant is unable to employ counsel, and is incapable of making his own defense… it is the duty of the court, whether requested or not, to assign counsel for him as a necessary requisite of due process of law’” (Lewis, 113). The next case brought to the Supreme Court regarding the right to counsel was 1938’s Johnson v. Zerbst, which concluded with Justice Black’s declaration that “the amendment now required the appointment of counsel for all who could not afford it in federal criminal cases” (Lewis, 114). The most controversial case, and the one that had the most effect on Gideon v. Wainwright, was the Betts v. Brady case of 1942. In this case, the Court ruled that a defendant was only entitled to counsel if the court could not provide a fair trial without it, and that a poor defendant was not automatically given counsel if he could not afford it. These three cases meant that the Supreme Court had already been grappling with the right-to-counsel conflict for 30 years by the time Gideon submitted his case, and another ruling on argument was bound to happen again.

guess who had a good night last night!! me!!!! :dozey:

 

i had just gotten in bed at midnight and was trying to fall asleep when i saw my cell phone go off. i got up and went over to it and i had a text from my friend asking me if i had finished my government outlines. i soon learned that i had done the wrong outline and had to do a much longer set of them. so i ended up staying up til 2 finishing them :dozey:

it sucked! but at least i finished it.

and we had a test in that class today too. but i feel like i did ok.

 

 

also, i got an 87 on my calc test which i thought i failed! :dance:

and that's one point over the class average :sneaky:
