Coldplay denies copying 'Viva La Vida'

LOS ANGELES (AP) — Coldplay has denied in federal court that it copied parts of Joe Satriani's music for its hit song, "Viva La Vida."

In a response filed in Los Angeles on Monday, attorneys for Coldplay's band members also argued that any similarities between "Viva La Vida" and Satriani's "If I Could Fly" weren't enough to warrant damages.

Satriani's song "lacks originality," Coldplay's response claims, and shouldn't receive copyright protection.

Satriani sued Coldplay in December, claiming the British band used "substantial, original portions" of Satriani's "If I Could Fly," which was released in 2004.

Satriani's lawyer, Howard E. King, said Coldplay's response was typical for copyright infringement cases and he reiterated that he thought the matter could have been resolved without a lawsuit.

Yes, of course they could have settled out of court - by handing over loads of cash to an undeserving idiot. The boys obviously feel really strongly that they did no wrong so I hope they run Satriani into the ground!

Oh - and feel free to merge this thread into the old one. I was just being lazy and couldn't find it...

I like satriani (people will kill me in my sleep for saying that), but not as much as coldplay. My friend became a coldplay fan because of me telling him about this suit. I think satriani just wanted attention, even though he is already famous. He is like boy george. Not a good person, but good music. My theory is that he stole chris' magic powers, travled to '08, then stole VLV, to then get attention.

you know, that's probably what happened.

..Satriani's timing with this suit could not be more off lol. I don't hate the guy (I'll probably be the next victim during my sleep :P) but I just don't agree with his belief that he has a solid case against Coldplay. And it's true, the boys clearly feel that they didn't do anything wrong.

"Satriani's song "lacks originality," Coldplay's response claims, and shouldn't receive copyright protection."....dem fighting words but hey if he wants a fight, he's getting one :P

Don't see him winning this though. Thanks for the update!

COLDPLAY GO TO COURT TO DEFEND VIVA LA VIDA

"COLDPLAY have sent their attorneys into court to defend them against a lawsuit from JOE SATRIANI over their hit song VIVA LA VIDA. The band publicly denied the claims and they have now hit back in a U.S. federal court - lawyers for the group filed a response in Los Angeles on Monday (06Apr09) alleging Satriani's song "lacks originality" and therefore shouldn't receive copyright protection." :laugh3:

"Coldplay's legal team also state any similarities between the songs aren't significant enough to warrant damages.

Satriani - who has played with Mick Jagger and Deep Purple - is seeking a jury trial, damages and "any and all profits" from Coldplay's song."

Did any one of you find any similarity between "If I Could Fly" and "Viva La Vida"?:dozey:

The vibe, the tempo, the chords are similar (not the same).

But for sueing someone, in my opinion it's not enough.

He only wants a piece of the cake.

He could have talked to Coldplay as the single FIRST came out (before the album) and not when the single was going to be a megahit.

This is ridicolous...

Although Satriani has taken some of this riffs from another person, so....:dozey:

the similarities are not that significant as to say that the song was copied....I'm sure that we've all heard songs before which sounded similar to another and at first you think its one song and then you realise that its not the song you were thinking..........................

Satrani needs to stop being a conniving piece of shit

He only wants a piece of the cake.

exactly! that's the point...

Also the Lawyer's are alleging that "Satriani's song ''lacks originality'' and therefore shouldn't receive copyright protection, also the similarities aren't significant enough to warrant damages." :wink3:

And another thread to talk about the song....................

well said. not to mention that this didn't come out until coldplay was nominated for all those grammys  he had to have heard it if not once, then several times before it was an issue. the song had been out ruling the world for many months already.

Hey Joe you know what? Why dont you go to fuck your mother?

Like Chris said in Yellow : You know I love you Joe :laugh4:...so go screw yourself

Im responding like this, because I met him this weekend and he is son of a bitch

Da da da daaaaa.... IronMan to the rescue, as he swoops in and picks up Joe, and flies him out over the pacific and drops him saying, "Viva la Vida."""" Death To all Enemies!!!!

oh sure ,,, there's similarity.

but i don't think this "lacks originality" defense is the way to go at all.

just deny deny deny.

Coldplay Vs. Joe Satriani, Round 3: The Snub

joe_satriani_06-200x300.jpg

Guess what, Joe Satriani? Coldplay don’t think they plagiarized you, and they’re willing to swear on a stack of bibles over it.

In a Los Angeles Federal Court on Monday, attorneys for the band responded to guitarist Joe Satriani’s lawsuit, which claims the multi-platinum British Band lifted the melody and chord progression to Satriani’s 2004 album track “If I Could Fly” for “Vida la Vida,” the hit single from their most recent album, Vida La Vida or Death and All His Friends. The band’s attorneys reiterated t any similarities between the two songs were not enough to merit a copyright infringement claim. They also said Satriaini’s tune “lacks originality.” In your face, Satriani!

Coldplay won a Grammy for “Vida La Vida” this year. In December, the band posted a message on their website, claiming “if there are any similarities between our two pieces of music, they are entirely coincidental and just as surprising to us as to him.”

Coldplay have jokingly admitted to plagiarism in the past, just not when any court money was riding on it. Satriani has been quoted as saying that hearing Coldplay’s song “felt a dagger went right through my heart.”

Stay tuned, folks. This could get ugly.

*sigh*

Thanks Ian

Music analyst says

that the two songs sounds remarkably similair and that he would go and testify to that

Some other expert guy says Satrani is doing it because Coldplay's pockets are deep.............

Ohh i'm not liking the sound of this at all

I have the feeling this will track on for a long long time and won't be very nice but good on the guys not to settle out of court like most of those cases. I bet that Satriani would loved to have setteled out of court....

I might phrased it differntly then the song lackes orginailty but guess this is now laywer's language anyways!

P.

Even IF it's really copied. It was a good copy.
