Global TV Canada's Competition T&C

 

There were a couple of points which interested me.

 

Rule 3.

There will be five (5) grand prizes (each, a "Grand Prize") awarded to five (5) winners (each, a "Winner") consisting of the following: return airfare for Winner and a guest ("Guest") from a major Canadian gateway city to Toronto, Ontario, departing on Tuesday, March 21, 2006 and returning Thursday, March 23, 2006; hotel accommodation (based on double occupancy) for two (2) nights at the Toronto Renaissance Hotel; two (2) tickets to see Coldplay live in concert at the Air Canada Centre in Toronto, Ontario, on Wednesday, March 22, 2006 (the "Concert"); one (1) SONY MINI DV CAM DCRHC26 to record the Concert experience; and two hundred dollars (CDN $200.00) spending money. For the purpose of these Contest rules, a "major Canadian gateway" means Vancouver, Edmonton, Calgary, Regina, Winnipeg, Toronto, Ottawa, Montreal, Quebec City, Halifax, or St. John's (each, a "Major Canadian Gateway City"). Approximate value of each Grand Prize is two thousand dollars (CDN $2,000.00). Actual value of Grand Prize will depend on departure city. Winner is not entitled to monetary difference between actual prize and the stated approximate prize value, if any. All recorded footage of the Concert shall be turned over to, and shall become the sole property of, EMI Music Canada immediately following the Concert for editing and possible inclusion in the forthcoming Coldplay DVD. The Winner acknowledges that EMI Music Canada has the right to grant a non-exclusive, royalty-free licence to broadcast the recorded footage without limitation.

 

Rule 12.

Subject to the jurisdiction of the Régie des alcools, des courses et des jeux in Quebec, Sponsors reserve the right, in their sole discretion, to cancel, amend, modify or terminate all or any portion of this Contest at any time for any reason without prior notice.

 

So at no point is it definite that any of the footage will be used for the DVD, it is "possible inclusion". And reading through those rules, at no point does it say that you will meet Coldplay. So why did EMI suddenly mention that elsewhere (if they did, the only thing we have to go on is hearsay and I don't really fancy being done for libel!)?

Its all very interesting.

Well reading "through the lines" it seems they could have changed anything as they liked...the hell....I hate how they put down these rules, cause you never expect things would change so much and never pay too much attention, and this is when they can cheat on you :dozey:

Jenjie is right. I read over the contest rules very carefully before I entered, and let me tell you, whoever drafted them made sure to cover their own behinds a dozen times over. They lived up to what they said the contest included exactly. Nothing less, but apparently, nothing more either.

 

But saying “I might act like a jerk” in no way excuses a person when they proceed to act like a jerk. It makes the band look bad, it makes anyone of any worth at EMI and Global look bad, and it disappoints not only the fans who won, but also the ones like me who stayed home and dreamed too. I was looking forward to seeing all the different perspectives on the DVD, as I’m sure were many others. Now it just seems like they thought a contest would be some good publicity and had no intention of actually following through. :sick: :(

 

Maybe my perspective is a little warped because I was really excited about this, but this contest was promoted like crazy over here, and treated like a big deal. It had a lot of people excited just by existing, even if they weren’t entering. It really should have been organised better if all the stuff said is true.

the fine print will kill ya. it should really say, hey be careful because we reserve the right to screw you up your butt and leave you in the streets of an unknown city at midnight... HAVE FUN!

Of course they've got to cover their backs. In this day and age, people will sue for anything. They have to ensure that they've made the competition as clear as possible.

 

They've basically said that they reserve the right to use the footage or not. They need to do that, if they promise footage from the winners is going to be used but none of its any good then what do they do? They can't use footage which doesn't come up to a certain standard, otherwise the fans will then be complaining that they've been ripped off with a shoddy DVD. The only way for everyone to win in that situation is to include a disclaimer that they reserve the right not to use footage.

I guess the whole dillemma this fan will face is written word versus spoken word. Signing off on some paper that said exactly what the contest rules said is very different than someone saying "Oh yes, you will meet them!". That was never in writing, and there's no way this fan can prove it.

 

I don't see the loophole, either...

 

 

 

All in all, it fucking sucks. What douche bags. I wouldn't have stood for it while there. I would have gone straight to the person, while being carted around, and said "Excuse me, but can we stop a minute and get the backstage footage?". I'd have raised such a stink while there you would have smelt it in China.

This is not new. I saw first hand what scumbags the record lable was on the Rush of Blood tour, way before Coldplay were EMI/Capitol's cash cow. They treated contest winners and fans like crap and I promise you the band knew nothing about it. Record company jerkwards can all go burn in hell.

Well it's like that contest in... Toronto I think? You know... they got to meet the band, but were told they couldn't have any pictures and THEN they sat in a certain section for soudcheck and Chris invited them down on the floor but the Lable reps said no.

But Jen has stated what I had mentioned before.... there was nothing in writing that said they would meet the band.. or the locale of the tix... so all beit the overall experience was a bad one for the fans... EMI really has done nothing wrong. They covered their asses as specified in the T&C Jenjie provided us with...

Oh yes I forgot that one..but that time the competition was promoted by a radio if I remember well :thinking:

 

To add one more thing..I know they didn't write the shooting of the fans would have been included for sure in the DVD, but if they didn't provide them with appropriate seats it's obvious the shooting won't be that good...at least that's what I think

the other thing I'm very interested in is this supposed fax, which told them that they would get to meet Coldplay. surely, if you were hacked off you didn't meet Coldplay, and people on another site were telling you to be glad that you received the prize as stated in the rules, you'd quote from the fax to back your story up. if it were me and I had the technology to do so, I'd scan and post the fax for the world to see.

It just seems really irrisponsible of EMI. Although they have covered themselves in the T&C for apparently EVERYTHING, it doesn't take away from the fact that they are flying these people to the city, putting them up in a hotel bla bla bla. In my book that involves the winners putting their safety into the hands of the record company. If they were expected to make their own way to the venue then this should have been made perfectly clear rather than making them think they would be getting taxis. I think if the organisers had been more honest with these people they wouldnt be quite so disappointed. I really feel for the person who sold their 5th row ticket. That really sucks. But when you check it doesn't say anywhere "you will get front row tickets". Guess this is a lesson for us all really, isn't it?

as for the thread itself..it's very sad and doesn't put nor EMI nor Coldplay in nice position.
