January 23, 201016 yr What he did isn't right, even if she had been older he would still have been very un ethical but what he did in this case does pretty much constitute rape. It doesn't help in the US though that the age of consent is about 204.

(10 is age of consent here as long as your partner is within 2 years of your age and over 10, then 16 is free choice except for teachers/carers/etc. Nobody really knows about the 10 law tho so they treat 16 as age of consent. I think when both parties are under the age of consent, it is assumed there is nothing to suggest that one has "taken advantage" of the other, as both are regarded as "innocents" in the eyes of the law.
