Here's a stupid legal question.

 

Say a man or a woman, but for ease of use, a man, drives to a hotel where he is staying for a couple nights on business. On the first night he meets up with his business buddies and they drink in the hotel bar, getting slightly drunk, however when the man returns to his room, he notices that he has left a bag in his car which he will need, so he goes outside to get the bag from the car's boot. However when he is in the boot getting his bag, some policemen arrest him for drink-driving as he was in charge of that vehicle when under the influence. Are the police right to arrest a man for drink-driving when he wasn't going to drink anywhere?
