Coldplay Will NOT Be Served With Lawsuit At Grammys, Lawyer Says

 

 

Despite earlier reports, Joe Satriani's lawyer said he will not corner band at show.

 

Things have been relatively quiet on the Joe Satriani vs. Coldplay front since the guitarist filed a copyright-infringement lawsuit against the band in December, claiming that Coldplay's "Viva La Vida" was too similar to the melody of his instrumental "I Just Wanna Fly."

 

Reports surfaced on Wednesday that Satriani was so fed up with the band allegedly dodging his attempts to serve them with papers in the suit that, according to Fox News, he planned an ambush at this Sunday's Grammy awards, where the group is up for seven awards. Among the nominations are Record of the Year and Song of the Year for "Viva la Vida," which is also up for Best Pop Performance by a Duo or Group with Vocals.

 

Fox reported that Satriani and lawyer Howard King were planning to "fill the Grammys with servers ready to pounce on [Coldplay singer] Chris Martin and his fellow bandmates." There were also plans to send a fleet of photographers to document the event. But King told MTV News on Thursday (February 5) that there won't be any such drama after all.

 

"The members of Coldplay have retained a lawyer, who has agreed to accept service of the complaint on their behalf," King wrote in an e-mail. "Therefore, there will be no attempt to personally serve the band while they are in Los Angeles." But had they not retained that lawyer, King said he would have cornered the band, "either at the Grammys or any of the other events we knew they are planning to attend."

 

Satriani is seeking a jury trial in the dispute, as well as damages and "any and all profits" attributable to the alleged copyright infringement. Coldplay responded to the suit within a week of its filing, writing on their Web site, "With the greatest possible respect to Joe Satriani, we have now unfortunately found it necessary to respond publicly to his allegations. If there are any similarities between our two pieces of music, they are entirely coincidental, and just as surprising to us as to him. Joe Satriani is a great musician, but he did not write the song 'Viva la Vida.' We respectfully ask him to accept our assurances of this and wish him well with all future endeavours."

 

A spokesperson for Coldplay could not be reached for comment at press time.

Does anyone know what time Australian the Grammy's are on? Also if they are being broadcast on any TV station of ours? Foxtel?

As far as I know, Free to air isn't showing them, but that might change. Arena will be screening it on Monday from 10am.

Well, the Australian press release says it's live to air, but I'm not sure about other countries. It used to be shown later, but that was when it was on free-to-air and it never rated that high, because by the time it screened, everyone knew who had won.

mm, i have to check that D: i live up in alaska, so if it airs at all different times, the live photoblog will be waaaaay before i see the grammys.

Bear, I believe it does matter. Their website says it will air 8 PM Eastern/Pacific time. So, I think you will see a tape delayed broadcast.

Our live broadcast of grammy will last for an hour long,I doubt the whole ceremony is only and hour long,so I believe they will cut it for some reason in the middle of the ceremony which seems quite strange. Correct me if Im quessing the lenght wrong

Joe Satriani's lawyers are no longer looking to pin down Coldplay at the Grammys this weekend – instead they hope the band brings home some awards.

 

"All of that has been averted now," said attorney Howard King, referring to yesterday's reports of process servers on the red carpet. "Coldplay have hired one of the finest entertainment firms in California, which is probably good for all."

 

Satriani is suing Coldplay for plagiarism, alleging that their song Viva La Vida borrows from his 2004 instrumental If I Could Fly. "Their new firm will have a keen understanding of the strengths and weaknesses of the claims," King assured Music Radar, "and will counsel the band to come to a quick and fair resolution of the situation".

 

The problems experienced so far, King said, have been caused by evasive British lawyers. "We tried to have a conversation with Coldplay. Their British lawyers said there wasn't anything to discuss. And then after we filed the lawsuit, they didn't agree to accept service of the complaint."

 

If the "British lawyers" continued to refuse the papers then King said they would be forced to "take care of matters at the Grammys".

 

But now all that's changed. With a Californian law firm to deal with, King seems all sunshine and roses. He can't wait, in fact, for Viva La Vida to take home a prize. "We hope Joe Satriani's song wins a Grammy," he said cheekily. "In fact, we hope Joe has a very big Grammy night!"

 

We wonder if he's been invited.

Are Lil Wayne and Coldplay so different?

 

This year's leading Grammy Award nominees have more in common than you might think

On paper, this year's Grammy powerhouses couldn't seem more different.

 

Lil Wayne is a street-wise rapper from New Orleans who offers wild glimpses of a wide range of scenes of urban life in America on his chart-topping album "Tha Carter III." Coldplay is an artsy rock band from England that offers well-heeled takes on international inspiration - from "Lovers in Japan" and "Chinese Sleep Chant" to "Cemeteries of London" - on "Viva La Vida or Death and All His Friends," named after a Frida Kahlo painting and featuring cover art from 19th century painter Eugene Delacroix.

 

Their differences go beyond the traditional ones of hip-hop and rock, of marketing and image. If they were movies, Lil Wayne would be the biggest summer blockbuster, while Coldplay would be wintertime Oscar bait, strictly art-house fare.

 

Lil Wayne goes into the 51st Grammy Awards Sunday night with eight nominations in six categories, including the prestigious album of the year. With seven nominations, Coldplay will take him on for album of the year, and they're the only artists to compete in all three of the evening's top categories.

 

But in 2008, at least in Grammy leaders' minds, there is no Hip-Hop America, no Rock America, no Old America, no Young America, only the United States of America, unified under the banner of popularity and excellence. Maybe that Obama dude - er, President Obama dude - really was onto something.

 

"You could definitely hear them both on a Top 40 radio station," says Steven Smith, host of Fuse's "Steven's Untitled Rock Show," adding that it hasn't always been that way. "[in music] there isn't really a generation gap anymore."

 

Breaking down barriers

 

After all, despite their obvious differences, both Wayne and Coldplay share a desire to break down barriers and cross genres.

 

Lil Wayne already has had a hit with rocker Kevin Rudolf on "Let It Rock," and he's readying a full-fledged rock album, "Rebirth," where he plays guitar and sings, due out in April. "He's done everything he can with hip-hop and has proven himself," Miami producer Infamous, who has three songs on the album, told Billboard magazine recently. "Now, he's about to prove himself as a rocker."

 

And Coldplay already has gained a lot of hip-hop cred, as singer Chris Martin worked with Jay-Z on "Kingdom Come" and with Kanye West on "Graduation." On the "Lost!" remix from "Viva La Vida," Jay-Z returns the favor with his rhymes.

 

"We're so alien to each other that it's fascinating," Martin told Blender magazine about the mutual admiration between Coldplay and hip-hoppers. "Neither of us understands how the other does what they do. In Devon, no one knows what rap is, or at least they didn't when I grew up there. But working with Jay-Z and Kanye influenced me in terms of their confidence. As English people, we find that hard: You're kind of insecure by nature. So to see someone like that, it's Christmas."

 

Inspired to experiment

 

It should come as no surprise, then, that Jay-Z, for his album inspired by the Denzel Washington movie "American Gangster" and the superstar collaboration "Swagga Like Us," and West, for his own part in "Swagga" and his collabos with Estelle, Young Jeezy and Lil Wayne, both landed six nominations. R&B singer Ne-Yo - who did his own experimentation with "Year of the Gentleman," bringing more European dance sounds into his music - was also a top nominee with six nods, including one for album of the year.

 

It's almost as if the Grammy folks planned it out, like they were trying to reward collaborations and those stretching genre definitions.

 

"The Grammy Awards process once again has yielded a comprehensive, diverse and eclectic group of excellent nominees across multiple genres," Neil Portnow, president and chief executive of The Recording Academy, said in announcing the nominees. "This year's nominations are truly reflective of the talented community of artists and creators who represent some of the highest levels of musical excellence."

 

That standard would help explain some of the biggest surprises of the nominations - including British world-beat rapper M.I.A.'s nomination for record of the year for "Paper Planes" and the five nominations for Philadelphia's Jazmine Sullivan, including best new artist, for her R&B tempered with reggae and the tango.

 

But maybe the Grammy committees were simply following America's lead, since Lil Wayne's "Tha Carter III" and Coldplay's "Viva La Vida" were 2008's top two selling albums. "Tha Carter III" even sold a million copies in its first week, showing it had far more than hip-hop appeal.

 

"Lil Wayne is just meant for this," says Smith, of Fuse. "He's one of the greatest rappers. ... He's a multigenerational performer who gained popularity through the strength of the underground. I think it's totally deserved. He really paid his dues."

 

Maybe the Grammys are warming to the way more and more people deal with music, flocking toward whatever catches their ear, regardless of genre. It's something much of commercial radio and many major labels, with their relentless creation of niches and sub-niches, continue to work against.

 

So, are this year's nominations the sign of a movement within music or simply a one-year aberration? We'll have a better idea when the winners are announced Sunday night.

Grammy party at Hard Rock Cafe

 

DESTIN, FL - Music will be in the spotlight Sunday as the music industry passes out the 51st annual Grammy Awards at the Staples Center in Los Angeles.

 

Coldplay and Lil Wayne, both of whom were big winners last year, lead the nominations again this year, but there's a lot of buzz in the music media about Robert Plant and Alison Kraus' album "Raising Sand."

 

You can participate in the festivities in your own home, of course, or, if you're looking for a place where someone else does the planning, cooking and cleaning, try Hard Rock Café Destin.

 

Located at Destin Commons, the café will be one of several Hard Rock Café locations across the country to host official Grammy Telecast Viewing Parties.

 

The event begins at 6 p.m., and admission is free. Details on the hardrock.com Web site encourage partygoers to dress as their favorite rock star and receive "red carpet" treatment. A press release says an award will go to the "best dressed" rock star in the café.
