I was really sick of hearing about this (and that it happened at all), but I don't know about this.... I mean they were very adamant about the fact that they didn't steal the song, so I don't think they'd really pay him to go away at this point. It seems like if that's what they were going to do they would have done it a long time ago.

I just think it's strange, because their lawyer even claimed that Satriani's song lacks originality. They were fighting back and it would be a shame if they'd give up now.

The legal burden of proof in such cases is on the accuser (Satriani). Personally, I think Coldplay had a decent chance to win, but the process would likely have been long and ugly, and taken an emotional toll on the boys. Personally, I'm glad this whole thing appears to be over, hopefully the band can now go forward with a weight lifted from them and Satriani can get back to his 39 minute tapping solos or whatever it is he's up to these days...

I guess it's confirmed now.

Guitarist Joe Satriani's lawsuit against Coldplay, based on his accusation that Chris Marin and co plagiarised his 2004 song 'If I Could Fly' for their 2008 single 'Viva La Vida', has been dismissed from court.

 

Satriani sued the band last December, seeking a jury trial to award him monetary compensation.

 

Now, according to News.justia.com, the case was dismissed yesterday (September 14) in California Central District Court "upon stipulation", suggesting that an out-of-court settlement may have been reached.

 

Judge Dean Pregerson decreed that both the parties bear their own trial costs as the case was closed.

These kind of lawsuits are ridiculous, because honestly there's no real way to prove either side, unless you have at time machine:dozey:

 

So even though I'm not happy they settled(if this is true), maybe it was for the best. At least now they won't have a chance of losing and getting loads of bad publicity.

But if there is no such law on copyrights, people will keep on plagiarising others' songs. It is actually necessary.

 

It's just that some people like Satriani misused it for his own advantage.

Well it's been dismissed, that doesn't mean Coldplay shelled out money, it could mean Douche bag decided it wasn't "Gonna Fly".:lol:

I think no matter how this story gets out to the majority of the public, people are going to be douchebags towards the guys like they always are and say "SEE! They copied it!" It infuriates me how Coldplay just can't seem to win.

It's possible the band threw Satch a hundred grand and said "shove off". It's also possible that Satch's lawyer told him it would cost more than he had to take the case to court, so Satch decided to pull out and Coldplay covered the court costs or something.

 

We may never know what happened. A gag order may have been placed on everyone involved, even after the suit was dismissed.

 

Nonetheless, our band will continue making great music and pleasing the fans, and that's really all that counts at the end of the day. The Satch fanboys will have their say, but not to worry, he will be a memory soon while Coldplay forges on.

I'm pretty sure that will never happen. They didn't really like discussing it while it was happening, I doubt they'll discuss if money changed hands.

Is it just me, or does 'dismiss' really make it sound like Sadtriani just decided to end the whole thing? That it would have cost him more money than it was worth to go to court?

One of the most common conditions of an out of court setllement (assuming there was one in this case.) is that all involved parties are prevented from disclosing the details, so I doubt ther will ever be an official statement from anyone involved as to what happened behind closed doors.

That's a great way to make money! :) Just play every single note randomly and you're BOUND to find someone who's played something similar so you can sue them :)

Definitly a bit disappointed that they may have settled. As it was said before, it kind of looks like Coldplay is admitting to wrong doing by paying him off (if that's what happened), so the haters will jump all over this. I suppose if they can afford it and just want to put the whole matter behind them and move on...

That's what I'm really not looking forward to also. People look for any chance to rip them apart. Although, even if Snatch came out and said "I was wrong, they didn't copy me. In fact I LOVE their music" and dropped the case entirely, people would still continue to attack them. The hate against just completely confounds me!!! If I got the chance to ask God ONE question. It wouldn't be 'what is the meaning of life', it would be 'why do people hate Coldplay so much?!'

They are nice guys, that's true. But everytime Chris was asked questions regarding the plagiarism suit, he would say that sometimes there are things that they will just not admit of doing and say no to simply because it's not true.

 

And I agree with him. They can be nice, but there are times when they need to make a stand.

 

But yeah..the case is closed now anyway. I hope this is for the best.
