Two weeks ago a judge told him to clean up his act or face jail.

 

Now heroin addict singer Pete Doherty is behind bars after being arrested for drug possession.

But while he was initially held in custody following his arrest by police, no-one is betting on him being jailed for this, his latest in a long string of offences.

For while drug police seek him here, seek him there, and find him carrying drugs pretty much everywhere, Doherty, 28, has proved astonishingly elusive where prison sentences are concerned.

Courts have repeatedly set him free after he has promised to go straight, regardless of his continual failure to do so.

And with Doherty continuing to mourn the end of his ill-starred relationship with supermodel Kate Moss - who has since nicknamed him "Slug" - there is no sign of him yet ending his out-of-control behaviour.

Although Scotland Yard would not confirm Doherty was involved in the latest incident, a spokesman said a 28-year-old was arrested in the early hours on suspicion of possessing drugs.

Doherty, who has recently been living at a run-down address in east London, close to his favourite crack houses, was arrested just hours after performing at the V Festival in Staffordshire on Sunday.

One reviewer said Doherty finished the set by demolishing the drum kit after starting four hours late, at 10pm, because of traffic.

A Scotland Yard spokesman said: "At around 2.30 this morning police in Tower Hamlets arrested a 28-year-old man on suspicion of possessing drugs.

"Two other people - a man and a woman - were also arrested at the same time.

"All three are in custody at an east London police station."

Doherty's lawyer Sean Curran said later: "I can confirm that Pete Doherty has been arrested. He is currently being held at Bethnal Green Police Station.

"I have been to the station this morning and will be returning later. I'm not willing to discuss this further."

Doherty, who was kicked out of his first band The Libertines before moving on to front Babyshambles, is currently under a drugs treatment order imposed by Thames Magistrates.

And at a court hearing before West London magistrates two weeks ago Doherty was warned he could face jail for admitting possession of heroin, crack cocaine and ketamine and driving illegally.

Doherty, who spent a week in rehab before that appearance in court, was told that he would have to show that he can go for more than a week without drugs. He is said to have undergone a stomach implant to help kick his habits.

The singer's long-suffering literary agent Paul Roundhill groaned "Oh no, not again" when he learned of the latest drugs arrest.

Mr Roundhill said he had not seen Doherty for a few weeks but insisted he had seemed to be getting over his drug problems.

Doherty went in rehab in Yorkshire again last month amid claims that former girlfriend Miss Moss, 33, was picking up the bill.

Mr Roundhill insisted Doherty did not deserve to go to jail, saying he was the "victim" of an illness and was "a good guy".

The agent said: "When I last saw Pete he seemed to be in great form. He really wants to do the right thing - he's quite a high-minded individual.

"It's just really sad, he had been seeming to get better."

Speaking about Doherty's court warning to clean up his act or face jail, he said: "It's a difficult situation.

"I think they need to look at it with some mature understanding and compassion.

"He's an incredibly prolific artist in a very new way. From the start he has had a bad deal.

"I think people saying he should go to jail is an ignorant analysis - it's unfair.

"Magistrates will avoid a prison sentence at all cost because there's such overcrowding.

"And Pete's crimes are against himself. If you have a drug problem it's a contradiction to treat possession of drugs as a crime. You should treat that person as a victim."

He said Doherty was still in regular contact with on-off supermodel squeeze Kate Moss, adding: "She paid for his last rehab in Yorkshire. They talk all the time."

He added: "It tends to be the people who commercially benefit from his work who have the say on what treatment he has.

"I hope this will just concentrate minds on establishing a realistic regime that helps him be creative.

He added: "He is generating so much money he deserved expert treatment."

Pete Doherty signalled his defiance with a V sign today as he walked free from court on a technicality after a police blunder.

The Babyshambles frontman had been expected to be jailed as he faced charges of breaching bail conditions following his latest arrest.

But the prosecution had to admit at West London magistrates court that it had no jurisdiction over him because he had not been produced in court within 24 hours of his arrest.

The former lover of Kate Moss has repeatedly been spared jail by courts in spite of a string of convictions. His latest escape came this morning when Anjulika Vatish, prosecuting, said: "Mr Doherty was arrested on 20 August at 2.35am.

"This court has no jurisdiction to deal with this matter any more." A clearly unimpressed district judge, Susan Williams, told the prosecutor:

"As you know, and the police ought to know, anyone arrested for breach of bail must be brought before the court and dealt with within 24 hours.

"Clearly, that has not happened on this occasion. No doubt the police have made arrangements for Mr Doherty's immediate release."

Today both the Crown Prosecution Service and a court official said the reason Doherty had not appeared in court within 24 hours was a matter for the police.

A spokesman for the CPS said: "Breach of bail has to be decided upon within 24 hours. If it is done after that period the complaint has to be withdrawn."

He said police were dealing with the matter of Doherty's suspected possession of drugs at the time of his arrest, yesterday morning, and added that no evidence had been presented so far.

A court official said he did not know why Doherty had failed to appear within the 24-hour time frame. He said: "As far as this court is concerned the matter is over."

The 28-year-old singer, who has had a stomach implant to help him beat his drug addiction, had arrived in a van handcuffed to a guard and looking dazed and dishevelled.

He was arrested in the early hours of yesterday in Tower Hamlets when police allegedly found Class A drugs in the car in which he was a passenger hours after he performed at a music festival.

But after a hearing lasting a few minutes, Doherty was released from the court cells. He did not even appear in the courtroom.

Wearing his trademark black trilby, he left the building in Hammersmith gesturing to waiting photographers before jumping into a green Jaguar and being driven away.

 

Scotland Yard said officers were urgently reviewing the situation but a source said it appeared there was nothing they could do.

 

The blunder will revive concerns about the performance of the prosecuting authorities and their ability to comply with often strict court rules.

Critics claim that despite recent efforts to improve prosecution performance too many cases can fall down because the correct paperwork has not been gathered or submitted in time.

As in today's case, this can potentially result in offenders who might otherwise be remanded in custody being freed or the cases being dismissed

Kate Moss's friends and family are devastated after learning she has run back into the arms of Pete Doherty. The supermodel has been secretly staying with the drug-addicted singer at Claridge's.

The Daily Mail has learned that the pair have been living it up in a £1,500-a-night suite at the Mayfair hotel for the past five days.

On one night, friends had to be ejected by hotel security when their revelry became too rowdy and the number of guests allowed per room was exceeded.

Doherty, 28, was last night pictured returning to the hotel after walking free from court on a technicality following a police blunder.

He had faced jail for breaching bail conditions. But because officers didn't bring him to court within 24 hours of his arrest, magistrates were forced to let him go.

There was no sign of Miss Moss coming or going from the hotel yesterday but sources said the pair had been meticulous about leaving and arriving separately.

Miss Moss has been arriving and leaving under the cover of darkness in recent days since returning from a holiday with friends in Spain.

Troubled rock star Pete Doherty has checked into a rehab clinic where he will be expected to vacuum the house, according to US magazine People.

The Babyshambles singer is making yet another attempt to kick his drugs habit at Clouds House, a clinic just outside Salisbury, Wilts.

Doherty, 28, spent part of Friday in group therapy at the £300 a night clinic, the magazine reported on its website.

The singer was dumped by supermodel Kate Moss last month after he allegedly had a fling with a South African model.

Since then, Doherty has been on the path toward self-destruction, being arrested again for possession of drugs last week.

A friend told People magazine: "He really needs help, and we're grateful he's getting it."

The 38-bed treatment centre, whose former clients are said to include Robbie Williams and Boy George, keeps its patients busy with a variety of chores, known as 'Therapeutic Duties'.

He will have to tidy his room, make his bed, keep his personal belongings in order, vacuum the lounge, and set the tables for dinner,

Doherty, the son of a British Army officer, will not be allowed to stay in his room, but will have to take part in a variety of group activities, and will have to attend lectures, workshops and watch educational videos.

But the singer will also be able to take part in several 'creative' activities.

Doherty, who published his diaries this year, will be set reading and writing assignments, and take part in art therapy, drumming workshops and do 'dramatherapy'.

He will also have access to a variety of alternative therapies, including Indian Head Massage, T'ai Chi, acupuncture, reflexology, aromatherapy foot massage and Shiatsu Massage.

Doherty has been addicted to drugs for at least five years since he found success with his first band, The Libertines.

He has been arrested an astonishing 13 times since 2005 and has been in rehabilitation at The Priory, a French clinic, a Thai monastery, a Portuguese clinic and The Meadows, a famous clinic in Arizona.

He is on bail after admitting last month to possessing crack cocaine, heroin, cannabis and ketamine. Last week he was arrested again on suspicion of possession of drugs when his Jaguar mounted a kerb in east London.

But police officers failed to produce him at court within 24 hours of the arrest, allowing him to walk free from court.

Oh wow, you were there?!! What a line up that was, you lucky thing.

 

I'm listening it to death at the moment and I can't see myself getting sick of it any time soon....I think it has much more 'staying power' than Waterloo to Anywhere, but I love Down in Albion to death and although it's far from a perfect album I don't think this could quite top it for me.

JUNKIE Pete Doherty is snapped appearing to give his kitten crack — from a mini-pipe he made specially for it. Sickened pals who leaked the picture claimed the warped rocker regularly gets the pet smashed.

They said it PASSES OUT with its paws in the air, suffers MOOD SWINGS and even thinks it can FLY.

One added: “In Pete’s mind it is the only one who understands him now.”

The Babyshambles frontman’s cat Dinger — named after a slang term for a syringe — had five kittens in April.

The friend said: “One in particular has borne the brunt of his drug abuse. Pete thinks it’s hilarious to get it wasted.

“He even made a special mini-crack pipe out of a bottle so it can get the maximum hit.

“But the kitten is starting to get really bad withdrawal symptoms.

“It has lost some of its balance and takes huge risks jumping over things that are too high. It thinks it can fly. It’s really distressing to see.”

Doherty, 28, tried in vain to woo back supermodel lover Kate Moss, 33, by sending her a framed photograph of her with Dinger — with the scrawled message: “There’s no place like home.”

He is currently in rehab before a court appearance on October 2 for possessing crack, heroin, ketamine and cannabis.

Last night the RSPCA said of the kitten picture: “It is hard to launch an investigation into possible abuse from just a photograph. There needs to be more evidence.”

DOHERTY’S kitten is not the first animal with addiction problems. In 2005 The Sun told how squirrels in Brixton, South London, became hooked on crack cocaine hidden by addicts in gardens. Residents said the tufties had bloodshot eyes and were “digging desperately” in flower-beds.

In the US, crack squirrels are a recognised problem in New York and Washington DC parks.

Babyshambles are back in the studio recording brand new songs.

 

The tracks are set to be B-sides for forthcoming singles from their second album, 'Shotter's Nation', which will be released on October 1.

 

Writing on his MySpace blog, Babyshambles drummer Adam Ficek revealed that the new song titles are entitled 'Jumping Bean', 'I Don't Know That Man', 'Fixing Up (To Go)', 'Fireman', 'Revelations', 'Maybeline' and 'Velvet Untitled'.

 

Meanwhile, a new video of Pete Doherty recording a brand new song, 'Darksome Sea', has appeared online. You can see the video now on the NME Office Blog.

Babyshambles frontman Pete Doherty appears to have swapped one addiction for another.

The reformed drug addict looked positively tubby as he emerged from a north London pub after meeting up with his bandmates.

Wearing a black suit and his trademark brown trilby, the singer's white shirt appeared to be straining against his greatly increased girth which seems to have expanded after spending a month in rehab to kick his addiction to drugs.

Clearly, Pete rediscovered his appetite for all things edible during his stay at the Clouds Clinic as the once waif-like Doherty looked much rounder in his face, but healthier than he has for some time.

Following his release from rehab, the singer, who is rumoured to be engaged to model girlfriend Irina Lazareanu, has been forced to take up residence outside London as part of his bail conditions.

Locals were thrilled when he turned up at local pub the Sun Inn.

An onlooker said: "It was a normal Saturday night until Pete rocked up.

"As soon as word got out, the place was packed and people were begging him to sing.

The source told The Sun: "He was asking for pints of Guinness as he paused between the tracks and was kissing all the girls who asked for one.

"It was a really great atmosphere."

Pete's band Babyshambles went to No5 in the album charts yesterday with Shotter's Nation.

The new sober Pete Doherty is adapting to life in the country and sobriety - as he swaps his bad old habit for a legal high.

Accompanied by model girlfriend Irina Lazareanu, Pete looked terrified as the couple enjoyed a fast and furious fairground ride.

He has exchanged his wildly destructive drug lifestyle for a calmer existence but the reformed drug addict admitted he's "not sure about complete abstinence".

He talked about his recent stint in rehab and his current drug intake today describing himself as "healthy, physically" on a radio show.

He told DJ Steve Lamacq: "I'm healthy, physically, a bit wobbly,".

"I'm not sure about complete abstinence [from drugs]. But it's a 12 step philosophy. It's one day at a time I suppose."

Doherty went on to talk about the psychological assessments he received in rehab.

"Apparently I've got loads of self-esteem issues," he said, before joking: "I thought I was alright!"

 

Pete's album has received rave reviews, and he has reportedly invited pal Amy Winehouse to visit him in his Wiltshire bolthole for jamming sessions.
