i don't think chris plagiarized (could he be so dumb??! to think he could get away with it if he really had plagiarized?), just an unfortunate coincidence.

this pumped me up so much!! i fucking love how satriani was all immature about it and then coldplay completely showed him up with this well put together statement while still defending themselves. i really dont think satriani stands a chance at winning this. first of all the songs arent that similar and secondly coldplay will be able to get a lot more people to help them. im happy they finally said something though.

I just came across this last night! I posted in the Releases = Viva thread, but I'll put it here too.

 

This song your about to play with the link below was recorded 2 years prior to Joe's song. And remember, for the whole 10 minutes or so of Joes Song, only 30 seconds or so are similar sounding to Viva la Vida. This song your about to click on completely destroys the Satriani case.

 

I have great respect for Joe's music, and any musician who can make it on instrumentals alone. But I am completely disgusted and dumbfounded at the complete morons gracing the youtube comments / tmz comments / etc, who attack coldplay on the minute as a lightweight, boy band, fufu, etc act. Coldplay is reliably still one of the greatest bands in existence, and I personally don't need them to be everyones favorite, just enough for the nearby arena to fill up for a night every couple years.

 

Haters be damned.

Given Satriani has requested a trial by jury and such trials are usually broadcast on TV in the US, this could be the most watched court case in history.

 

Are plagiarism cases filed in federal or state courts? If it's in a federal court, we won't be seeing it.

I have a huge amount of respect for Joe, i've listened to him since I was a teenager but I think he's taken this a bit too far. There are 5 consecutive notes that are the same and that's where the differences end, i'd hardly say it's grounds for a plagiarism case.

The thing that is interesting about the second article is the mentioning of the red Hot Chili Peppers's Dani California. When I first heard that song I thought of Tom Petty's Mary Jane's Last Dance. I didn't know that no credit was given to Tom Petty and he didn't demand anything either, and the funny thing is he has a more legitimate claim of plagiarizing that Joe.

:PObviously Joe Satriani hasn't got a ghost of a chance, but maybe Coldplay stole it from another source?? It could be taken from one of Mozart's earlier works, for instance.. Glad they responded, and even more glad that it's nothing like what Satriani had to say about the issue. He came off as whiny and acted like he wanted everyone to feel sorry for him.

Honestly, I think it's pure coincidence. I don't think Coldplay knew Joe's song and were even "inspired" by it. The fact that only the SUNG verses are similar to a guitar part is a little iffy to me. It's not the bulk on the song. It's not the instrumentation, or the chorus, or anything. Just the verses. Which, of course, is enough to be considered plagiarism. However, it's not note for not identical, so there is SOME room for argument. It's one of those "too close for comfort" things. It could really go either way, depending on the jury.

 

I can see where Joe is coming from, they are similar, but his timing is REALLY iffy. The song's been out for a WHILE now. Why now? Conveniently after the song is nominated the most prestigious awards in the business. Awards that, if he had his name in the writing credits, would earn him Grammys. And if not, would prevent them from winning. So that MIGHT work against him. There's no real way to predict the outcome of this one, unfortunately!

 

I just hope this doesn't affect the Grammys!

Coldplay Responds to Infringement Claim

Even when the members of Coldplay respond to accusations that they have plagiarized someone’s music, gosh darn it if they aren’t the most polite rock stars in the business. Last week the guitarist Joe Satriani sued the band for copyright infringement, saying that Coldplay had taken “substantial original portions” of his song “If I Could Fly” for its song “Viva la Vida.” In a statement reported by The Associated Press on Tuesday, Coldplay said, “If there are any similarities between our two pieces of music, they are entirely coincidental, and just as surprising to us as to him.” The statement added: “Joe Satriani is a great musician, but he did not write the song ‘Viva la Vida.’ We respectfully ask him to accept our assurances of this and wish him well with all future endeavors.”

Yesterday I watched an entertainment show on TV and suddenly this news came out. The host is really annoying and obviously backing up that Satriani. And she pronounced Viva La Vida strangely, Vivelevide like that. Damn her.

This is slightly worrying:

 

The Satriani track comes from his album "Is There Love in Space?" Some enterprising fans have created "mash-ups" of the songs, overlaying Satriani's guitar playing over the Coldplay tune to indicate that they seem to share similar chord and melodic structures.

 

Intellectual property attorney Oren J. Warshavsky, a New York-based partner with national law firm Baker Hostetler, said Satriani could prevail by proving "striking similarity" between the two compositions. The law would then assume the only explanation for the similarities must be copying rather than coincidence, he said.

 

Additionally, Satriani could point out that his song is already published and widely disseminated, which "may be a more logical and compelling argument" then Coldplay's allegation that this is merely the result of coincidence, he said.

 

A court also could find that Coldplay copied the song unconsciously, Warshavsky said. This issue tripped up balladeer Michael Bolton, who lost a case against the Isley Brothers over their similarly named tunes "Love Is a Wonderful Thing." George Harrison's "My Sweet Lord" also was deemed to be an unconscious copy of the Chiffons' "He's So Fine." But in a complicated legal twist, the former Beatle ultimately ended up as the owner of the Chiffons song.

I LOVE the Coldplay statement but:

 

1. Joe Satriani spoke from the cuff, and it was probably ill advised; the Coldplay statement was prepared. It's night and day.

 

2. This is a moral victory only. This thing is not even close to over.

 

3. I am interested in the legality of all this. All we have so far is a "yes you did, not we didn't" situation.

As was stated in the Boston article that I posted a link to in a previous post, Joe will probably walk away with some money. As much as I hate that I do agree that he will get some royalities, but not all the royalities. It doesn't matter if it's intentional or coincidence, the plaintiff always walk away with money.

 

Also, it really is dawning on me that in the public's eye, Coldplay is guilty of plagiarism. It seems like all the votes and posts that I have seen seem to be in favor of Joe. These people think the Coldplay intentionally copied Joe's song. Man, these people are idiots!!

 

I don't have a link but I read an article from someone who was watching the case closely. Basically the writer was saying that maybe it was time for the copyright laws to be rewritten because it's to the point where all artists can claim that someone has copied their music. Whether what was copied was a few notes to almost a whole song, the person making claim and getting reward has become too easy.

I'm glad that Coldplay made a statement about this and I hope that the matter can somehow be resolved without a court case.

I agree with you about it being strange that these claims are only being made now after the song has been out for months!
