I am indebted to Telegraph reader Bob for pointing this out. It's another song that sounds pretty much exactly like Coldplay's 'Viva La Vida', this time by French pop singer Alizée, which came out in 2003, a year before Satriani's 'Learning To Fly', which appeared three years before Creaky Boards debuted their presciently titled 'Songs I Didn't Write', which they played at the CMJ music festival before an audience they claim included someone who looked very like Chris Martin, whose own variation on the increasingly familiar chord sequence and melody appeared this year.

So if Satriani is suing Coldplay, should Alizee sue Satriani? We'll leave Creaky Boards out of it cause they've obviously got no money.

 

Songwriters are always talking romantically about plucking songs out of the ether. Chris Martin would probably be well advised to have a lawyer present the next time he tries that.

AS if the whole COLDPLAY-stole-my-song circus wasn’t silly enough, a third track has now appeared, with claims it is the inspiration for Viva La Vida.

But the discovery of French singer ALIZEE’s track by music fans could actually be good news for CHRIS MARTIN and Co.

 

Guitar legend JOE SATRIANI is already suing the band, claiming Viva La Vida contains “substantial original portions” of his 2004 song If I Could Fly.

 

But Alizee released her single, J’en Ai Marre, a year earlier, so Joe’s lawsuit could fail as he could be accused of copying her.

 

To add to the confusion, New York band CREAKY BOARDS are maintaining their aptly-named The Songs I Didn’t Write was the tune Chris “stole” from.

 

Even the finest legal minds in America are going to have a hard time getting their heads around this one.

 

An industry expert, who spent the weekend studying all four tracks, said: "The chord structure, build-up and instruments in all appear to be identical.

 

“However, there are only 12 notes that exist in music, for example La Bamba and Twist And Shout share the exact chord structure.

 

"So some songs will naturally sound similar."

I agree. Can you just imagine how it must feel to have someone publicly claim your work, after you spend the best part of a year on it. They must be seriously p*ssed off!

I think the band was involved with the statement. I think the band consulted their attorneys and together came up with the perfect statement which the attorneys wrote up and made available to the public.

 

Overall, this whole thing is ridiculous. I think most agree that the timing of the lawsuit is suspicious, that any similarities is purely coincidental, and that the way Coldplay has handled this has been very professional, perhaps with the exception of Chris's joke during the Yahoo Nissan set.

 

A little off topic but I can't help but there's another controversy going on in the music biz and it has nothing to do with Coldplay. I saw on the news yesterday about the controversy between Lady Gaga and Christina Aquilera...who stole whose look? LOL!! I can't help but think what is going on in the music business?!

Of course it sounds a bit like lawyer speak. In a statement like that one misplace comma, let alone word can make or break a case, and in fact has before.

This song your about to play with the link below was recorded 2 years prior to Joe's song. And remember, for the whole 10 minutes or so of Joes Song, only 30 seconds or so are similar sounding to Viva la Vida. This song your about to click on completely destroys the Satriani case.

 

I have great respect for Joe's music, and any musician who can make it on instrumentals alone. But I am completely disgusted and dumbfounded at the complete morons gracing the youtube comments / tmz comments / etc, who attack coldplay on the minute as a lightweight, boy band, fufu, etc act. Coldplay is reliably still one of the greatest bands in existence, and I personally don't need them to be everyones favorite, just enough for the nearby arena to fill up for a night every couple years.

:thumbsup: Good statement! And regarding what people are saying about whether or not the band had anything to do with it- I'm sure Coldplay sat down with their lawyers and they all came up with it together. There's no way that they were completely uninvolved.

 

Overall, a very mature statement, and makes that horrible whiny article with Satriani look even more pathetic than it already was (which is saying something!). :rolleyes:

Coldplay Reject Copyright Lawsuit

 

 

Brit band Coldplay has rejected accusations made by American guitar virtuoso Joe Satriani that they ripped off one of his songs.

 

In a lawsuit filed in LA last week, Satriani claims the hit single Viva La Vida contains "substantial, original portions" of his 2004 song, If I Could Fly.

 

The 52-year-old is seeking damages and "any and all profits" attributable to the alleged copyright infringement.

 

It came a day after the band was nominated for seven Grammy Awards - including for the single Viva La Vida.

 

In the coveted record of the year category, Coldplay was nominated for their album Viva La Vida, or Death and All His Friends - their first release in three years.

 

In a statement posted on their website, Coldplay wrote: "If there are any similarities between our two pieces of music, they are entirely coincidental, and just as surprising to us as to him.

 

"Joe Satriani is a great musician, but he did not write the song 'Viva La Vida.'

 

"We respectfully ask him to accept our assurances of this and wish him well with all future endeavours."

 

Earlier this month, Viva La Vida, or Death and All His Friends was named the biggest-selling iTunes album download this year.

Why don't more people know about this!!!???? Granted it's the same song as Satriani's but i'm not gonna stoop to his or some of his fans level and say SUE SUE SUE! I'm sure it's a coincidence (a 100000000000000% bigger one than what HE'S claiming against Coldplay), so he should just realize that music is so massive and sometimes things MAY sound kinda the same doesn't mean everyone is ripping off everyone. He needs to just drop the case (but I know he won't because he seems pretty convinced and he'd look foolish. So I guess he's kinda stuck with either A. losing a court case and looking like an idiot or B. withdrawing his claim and letting down most of his fans)

As much as I LOVE the statement, it also tells me that there is no middle ground to work toward. Clearly, Satriani is confident that Coldplay stole his music. Clearly, Coldplay is confident that they were in no way influenced by his song. This is now a zero-sum game. I do not see how you can avoid a court case on this one unless Satriani backs down.

 

Given Satriani has requested a trial by jury and such trials are usually broadcast on TV in the US, this could be the most watched court case in history.
